- Services Provided: Zephony provides custom AI product development, software engineering, and hosting services, as detailed in your specific service agreement or project proposal.
- Payment Terms: Payments for our services are due as specified in the service agreement or project proposal. Payment schedules are agreed upon before project commencement and are necessary to maintain the flow of work.
- No Refund Policy: Once the software development process has begun, Zephony does not offer refunds. This no-refund policy is due to the allocation of resources, including labor, software, and operational costs, immediately upon the start of the project.
- Project Process and Adjustments: Details about the specific phases of the software development process are available on our Process Page. You agree to cooperate and provide necessary information for the successful completion of the project. Any requests for adjustments to the project scope or deliverables must be submitted in writing and may be subject to additional charges.
- Intellectual Property Rights: Upon final payment, ownership of the developed software and related intellectual property rights will be transferred to you, the client, as specified in the service agreement. However, Zephony retains the right to use and showcase the work in our portfolio and promotional materials unless explicitly agreed otherwise.
- Confidentiality: Both parties agree to keep any shared proprietary information confidential and will not disclose it to third parties without prior written consent.
- Termination: You may request the termination of services at any time. If you choose to terminate the project before its completion, you will be responsible for the expenses incurred up to the point of termination. Please note, as specified under our No Refund Policy, payments already made will not be refunded.
- Limitation of Liability: Zephony will not be liable for any indirect, special, incidental, punitive, or consequential damages of any kind related to this agreement.
- Dispute Resolution: Any disputes related to these Terms and Conditions will be resolved through negotiation, mediation, or arbitration, as necessary.
